URGENT: Courts ‘Unlikely’ To Stop Trump If He Declares National Emergency At Border Today


President Trump is taking very seriously the option of declaring a national emergency to build the wall on the southern border with Mexico.

To bypass a recalcitrant Congress with its heels dug in, Trump could take the extraordinary route of declaring a national emergency in response to the border crisis.

That way, he could get his wall without a single Democratic vote.

And now, legal analysts are saying such action by the President would be perfectly legal.

Heck, even the legal analysts hired by CNN think the President would have the law on his side!

Jeffrey Toobin, CNN’s chief legal analyst, said on Thursday he thinks it is “unlikely” the courts would stop President Donald Trump if he declared a national emergency and shifted money toward the construction of a wall on the southern border.

John Berman, co-host of CNN’s New Day, asked Toobin if it would be legal for the president to declare a national emergency to put money toward a wall.

“I think it probably is,” Toobin responded. “I think it is unlikely to be stopped by the courts, let’s put it that way.”

Toobin cited the president’s broad emergency powers and the challenge of finding a plaintiff with standing to sue as reasons why a legal challenge to an emergency declaration would likely fail. …

On Wednesday, President Trump again toyed with the idea of declaring a national emergency to build the wall.

President Trump warned on Wednesday that he reserved the option of declaring a national emergency to build his border wall without congressional approval. …

Asked whether he was still considering declaring a national emergency, an extraordinary measure rarely used by presidents absent an urgent security threat, Mr. Trump said: “I think we might work a deal, and if we don’t, I may go that route. I have the absolute right to do national emergency if I want.” …

Everyday, it appears more and more likely that Trump will declare a national emergency to build the wall. It might even happen as soon as this week and maybe even today.
